MUHIMMAN ABUBUWAN DA SUKA FARU A ZAMAN KOTU NA YAU 21/7/2022

Yayin da aka cika shekara ɗaya da kwana biyar cif da fara shari’a tsakanin gwamnatin jihar Kano da Abduljabbar akan zargin yin ɓatanci ga Annabi SAW, yau an ƙara zama domin cigaba da sauraron shari’ar, wanda kuma yau shi ne zama na 23 a cikin jerin ranakun da aka zauna.

Zaman na yau ya zama taƙaitacce.

Kuma ba a samu damar ƙarasa yi wa Abduljabbar tambayoyin da aka fara yi masa ba. Saboda rashin lahartar lauyansa.

Duk da cewa zaman bai yi tsayi ba, akwai muhimman abubuwan da suka faru a zaman, ga kaɗan daga cikinsu:

1. Dalilin rashin zuwan lauyan Abduljabbar: Bayan alƙali ya zauna, lauyoyin gwamnati, ƙarƙashin jagorancin Barrister Surajo Sa’ida SAN, sun gabatar da kansu, an juya ɓangaren wanda ake ƙara amma ba a ga lauyan da yake kare Abduljabbar ba.

Wannan ya sa aka tambayi Abduljabbar, shin yana da masaniya akan rashin zuwan lauyan da yake kare shi???

“Eh, ina da masaniya” inji Abduljabbar.

Kotu: Menene ya faru?
Abduljabbar: Wannan ya biyo bayan zama na ƙarshe da wannan kotu tayi. Kuma gini akan faɗin Allah, inda yake cewa:
ولا تلقوا بأيديكم إلى التهلكة…
Wato kada ku halaka kanku da kanku, shi yasa na rubuta takarda zuwa ga Alƙalin alƙalai, domin ya taimaka ya canja min wata kotun ta wani alƙalin daban. Shi yasa lauyoyina basu zo ba.

Alƙali: Kana so a ɗauke wannan shari’ar daga nan, kamar yadda ka faɗa, ko menene dalili?

Abduljabbar: Ina so ne a samu wani alƙalin daban wanda ba shi da jituwa da dukkan ɓangarorin shari’ar.

Kotu: To menene aibu na da baka so na cigaba da shari’ar?
Abduljabbar: Ai na rubuta wa Alƙalin alƙalai, kuma na san zai taɓaka…

Bayan alƙali ya turza, Abduljabbar ya faɗi dalilansa da yasa yake so a ɗauke shari’ar a kai ta wata kotun daban.

(Zan kawo su a taƙaice domin kada rubutun ya tsawaita). Ga su kamar yadda ya faɗa:-

A. Tun farkon wannan shari’ar na bayyana cewa wannan mas’ala ce ta ilimi wadda na yi zuzzurfan bincike a kanta.

Kuma a gaban kowa alƙali ya yi min alƙawari yace idan na zo kariya zai bani dama in zo da littattafaina ko da sun kai cikin a-kori-kura.

Amma tun da aka zo za’a shiga kariya nake fargabar kada a dinga tare ni idan ina bayani, ko a ce min bayani ya isa haka, ko ace min abinda nake so na faɗa ba shi da alaƙa da tuhuma.

Musamman ma rana ta ƙarshe wadda aka zauna kafin tafiya hutun azumi, ranar da daga ita lauyana SAN bai ƙara zuwa ba.

In za’a duba record din kotu, za’a ga cewa ina cikin bayani sai lauyana SAN ya daka min tsawa, ya fitar dani daga cikin sukan da nake yi na 8 a cikin 16 da naso nayi a lokacin. Na shiga suka na 9 kenan, sai kai ma alƙali ka tsoma baki akan lallai na bar wannan suka.

Sai shi lauyan nawa (SAN) ya ɗauke ni ya koma da ni kan maganar danna recording wanda suke a gaban kotu.

Kuma a gaban kowa yace min ‘ko na yarda da hakan, ko kuma ya fita daga shari’ar’.
Kuma na fahimci so yake mu yi ɓatacciya da shi, sai a ɗauka a yaɗa a ce ina yin faɗa da lauyoyina.

Kuma alhali waɗannan sukar da nake so na yi, su ne ƙashin bayan kariya ta.

B. Batun record ɗin shari’ar da kotu take rubuta wa, an wayi gari ana samun canji, ƙari ko ragi a kan abubuwan da aka yi a kotu.

Kwanaki na samu hakan, kuma na yi maka magana kace a zo a sameka a duba. Kuma aka duba aka samu akwai gyara, kuma ka gyara.

Amma fushin da naga ka yi a lokacin yasa na haƙura da sauran abubuwan da nake gani akwai gyara a cikinsu.

C. Lokacin da lauya na SAN ya fita, na faɗa cewar na samu lauyoyi har 3 wanda zasu tsaya min, amma sai mun gama samun matsaya da su, sai su ce min ana yi musu barazana da rayuwarsu, saboda haka ba zasu iya ba, amma a gaban kowa lauyan gwamnati ya ƙaryatani.

Kuma shi wancan lauya SAN, ina da ƙwaƙƙwarar hujja akan cewa wani ɓangare daga cikin masu ƙara ta, sun siyeshi bisa alƙawarin za’a bawa ɗansa wata kujera a Abuja.

Hakan yasa lokacin da kotu ta kawo min wannan lauyan (Dalhatu), na faɗa masa cewa buƙatu na guda 3 ne.

i. An hanani gabatar da bayanai yadda nake so.

ii. Samun ragi, ƙari ko canji a record ɗin kotu.

iii. Lauyoyina na farko na cune/shune, su Rabi’u Abdullahi, waɗanda suka so su mayar dani mahaukaci, sun hanani yin magana a kotu a lokacin da ake tambayata game da tuhumomin da ake yi min. Kuma alhali na tambayesu idan nayi shirun menene hukunci? Suka ce min babu komai.

Sai ga shi bayan na yi shirun an ce aje a auna ƙwaƙwalwata, kuma aka tambayi lauyoyin nawa suka ce basu da suka.

Kuma suka bi ni inda nake tsare, na tambayesu idan aka auna aka ce bani da hankali menene makoma? Suka ce min ai KILLACENI ZA’A YI kuma a hanani yin abubuwa na yau-da-gobe (kamar karatuttuka da rubutu).

Haka shi Rabi’un ya dinga bi na yana bani tsoro akan lallai na amince bani da hankali, saboda bani da amsa akan tuhumomin da ake yi min, kuma hukuncin kisa ne a kai.

3. Zaman da aka yi na ƙarshe, lauyan gwamnati yayi ya min tambayoyin da ya ga dama wanda basu da alaƙa da tuhuma.

Amma lokacin da yazo magana a kan chaji, ya ambaci kalmomin fyaɗe, ƙwace da auren dole. Amma sai bai tambayeni kalmar zina ba, wadda kuma tana cikin tuhumarsu.

A lokacin da lauyana yaga an tsallake kalmar zina, sai ya tashi domin yayi objection, amma sai naga ka yi masa tsawa kace ya zauna. Sai naga ai kamata yayi ka bari yayi tambayar sai a nemi su amsa. Sai gabana ya faɗi, kuma nake JIN TSORON hukuncin da zai iya faruwa a ƙarshen shari’a.
Waɗannan sune damuwa ta.

Kotu: Shikenan ka kammala?
Abduljabbar: Akwai wasu amma zan taƙaita a nan.

Kotu: Ko zaka iya faɗar waɗansu aibin nawa in akwai?
Abduljabbar: Waɗannan sun isa.

Bayan Abduljabbar ya kammala faɗin jawabansa, an nemi lauyoyin gwamnati su ce wani abu. Kuma sun tashi sun bayyana cewa suna da abubuwan cewa da yawa, amma zasu dakata har sai lauyan Abduljabbar ya zo kotu. Saboda bai kamata su yi magana a lokacin da lauyansa bai zo ba.
Kotu kuma ta amince da hakan.

2. Makomar lauyan Abduljabbar: Lauyan gwamnati, Barrister Surajo Sa’ida SAN, ya magantu akan rashin zuwan lauyan Abduljabbar, inda ya bayyana cewa dokar da ta sa aka kawo lauyan ta tilasta masa zuwa kotu, ko da ace yana da wani uzuri, ko yana so ya fita, dole ne yazo kotu ya faɗa.

Sannan kuma lauyan gwamnatin ya nemi kotu ta ɗage shari’ar zuwa zama na gaba domin jiran zuwan lauyan Abduljabbar.

Kotu: Wannan lauyan dai kotu ce ta naɗashi bisa doron doka.

Kuma naɗin nan yana nan, babu wata hanya da za’a iya canja wa naɗin suna. To muƙaddara ranar da aka saka domin cigaba da shari’ar ta zo, kuma lauyan ya ƙi zuwa, shikenan sai mu dakata sai ranar da yazo?

Lauyan gwamnati: Idan bai zo ba, sai mu sanar da Attorney General, don a ɗauki matakin da ya dace a kansa. In kuma aka ƙara ɗagawa, sai a tambayi wanda ake ƙara, idan zai kawo wani lauyan da kansa to shikenan sai a cigaba.
Idan kuma ba zai iya gabatar da wani lauyan ba, sai kotu ta ƙara kawo masa wani.

Alƙali: Ni a fahimta ta, babu wani mutum, ko da lauya ne, da zai zauna ya fito da wata dabara da zata dakatar da kotu daga yin shari’arta.

A fahimta ta, ƙin zuwan da lauyan yayi; yana sane. Kuma shiri ne kawai don kawo tsaiko a wannan shari’a.

Don haka, ina sanar da wanda ake ƙara cewa: YA SANAR DA LAUYANSA YA ZO A ZAMA NA GABA, domin ya cigaba da yin aikin da aka ɗora masa.

In kuma wanda ake ƙara ya ga dacewar ƊAUKAR WANI LAUYAN ZUWA ZAMA NA GABA, to ya ɗauka kafin dawowar. In kuma wanda ake ƙara bai ɗauki wani lauyan ba, kuma shi wancan lauyan (Ɗalhatu) bai zo a zama na gaba ba, to KOTU ZATA CANJAWA WANDA AKE ƘARA WANI LAUYAN…

3. A ƙarshe alƙali ya dage shari’ar zuwa ranar 28/7/2022.

Game da hujjojin da Abduljabbar ya dogara da su, da kuma sukar da yayi, nan gaba kaɗan zamu kawo muku fayyataccen bayani akai insha Allahu.

Amma kafin nan. Game da abinda Abduljabbar ya faɗa akan lauyansa A.O. Mohd SAN.

 

Haka nan, idan kun bi wannan link, zaku iya tuno haƙikanin abinda ya faru a zama na ƙarshe wanda Abduljabbar ya jujjuya al’amura. Musamman akan batun Objection da shi Ɗalhatu yake cewa an hana shi.

Muna roƙon Allah madaukaki Ya taimaki gaskiya da masu gaskiya, Ya kuma rusa ƙarya da maƙaryata.
Muna rokon Allah Ya ƙasƙanta ya wulaƙanta duk masu ƙoƙarin kawo tsaiko a wannan shari’ar.
